Once you have found a property that you would like to purchase, we prepare an offer for the seller. This takes place within the framework of a purchase contract, including all relevant things such as purchase price, amount of deposit, the period during which you maintain the offer and more. The down payment is usually not very high, but it shows the seller that it is a serious offer and it is absolutely normal to send it along with the offer. The offer also indicates whether you intend to finance the purchase of the property or whether you wish to purchase the property in cash. Cash, in this case, does not mean cash, but that you want to purchase the property with your own available funds.
If your offer is accepted by the seller on your terms, the purchase contract is considered concluded. The seller sometimes submits a counteroffer, usually if he does not agree with the purchase price offered. Now it is up to you to accept or reject this counteroffer. Your original offer has expired with the counteroffer. In the event of an agreement, the further procedure is transferred to the title company, which is chosen by the seller in Lee County and by the buyer in Collier County. In principle: Whoever pays the title policy may choose the title company. The title company handles the land register investigation. This includes checking whether there are any encumbrances on the property, whether the seller is actually the rightful owner or whether the property is subject to easements or other usufruct rights. The buyer then takes care of an independent inspection of the property. If financing is required, an appraisal (value appraisal) is usually requested by the financing provider. The so-called closing is the day on which the contract is signed, and the property handed over, comparable to the German notary appointment. The buyer and seller do not necessarily have to be present on this date. When selling, it is important that the seller’s signature is notarized. Unlike in Germany, however, all rights and obligations are already transferred from the seller to the buyer at the closing.
